Terms and Conditions

Welcome to ClipMode.ai. These Terms and Conditions (“Terms”) govern your use of the ClipMode.ai website and services (collectively, the “Services”) operated by ClipMode, LLC, and any images, models, information, text, graphics, video frames, or other materials you upload, download, train, or generate through the Services. By accessing or using the Services, you agree to be bound by these Terms.

Content Safety and Automated Enforcement

Effective June 1, 2026, ClipMode maintains a safety-first, SFW-oriented platform. Prompts, reference uploads, trained models, and generated outputs are subject to automated classification, policy checks, and manual moderation. We may log, block, or remove content before or after delivery.

ClipMode is NOT a “nudifier,” “undressing,” or clothing-removal application and must not be used as one. Any attempt to use the Services to remove clothing, sexualize subjects, or create non-consensual intimate imagery is strictly forbidden.

AI Character and Media Generation Rules

Prohibited content. The following categories are prohibited in prompts, training data, and outputs:

1. Minors: Any content depicting, referring to, or appearing to involve individuals under 18.
2. Non-consensual acts: Content indicating lack of consent, including coercion, sexual violence, or abuse.
3. Violence and mutilation: Graphic injury, torture, or extreme violence against persons.
4. Illegal activities: Promotion of illegal drugs, weapons trafficking, or other unlawful conduct.
5. NSFW and pornographic content: Explicit sexual content, nudity intended for sexual gratification, or obscene material.
6. Deepfakes and deceptive realism: Producing realistic depictions of identifiable real persons to deceive, defraud, or mislead others, including non-consensual intimate imagery (NCII), without the subject’s explicit consent. Stylized or clearly fictional creative work that does not intend to deceive is not permitted if it depicts identifiable real persons without consent.
7. Impersonation and fraud: Impersonating real individuals, brands, or officials to mislead others, conduct scams, or facilitate fraud.
8. Privacy violations: Using the Services to violate a person’s reasonable expectation of privacy or publicity rights.

If you encounter violating content, report it immediately to legal@clipmode.ai.

Prohibited Uses of Generation Features

You agree NOT to use image, video-frame, or animation generation functionality (including outputs from trained character models) to:

1. Impersonate any person or entity without authorization;
2. Conduct scams, phishing, or other fraudulent activity;
3. Create political campaign materials that misrepresent endorsement or identity;
4. Produce deepfakes or synthetic media with intent to deceive, defraud, or mislead;
5. Violate privacy, publicity, or data-protection rights of others;
6. Generate violent, hateful, or harassing content targeting individuals or groups;
7. Forge identification documents, credentials, or official records;
8. Circumvent safety systems, probe moderation, or distribute tools to bypass our policies.

Child Safety

The Services are for adults 18 and over only. Uploading reference images of minors is strictly forbidden. If we identify content featuring minors or apparent minors, we will immediately remove such content, suspend the account, and report instances of potential child exploitation or abuse to appropriate law enforcement or child-protection organizations where required or appropriate.

1. Basic Terms

You are responsible for your use of the Services and for any content you provide, including compliance with applicable laws. You should only provide content you have the right to use and are comfortable sharing with our systems and service providers.

2. Eligibility

You represent and warrant that you are at least 18 years of age and that your use of the Services complies with applicable laws in your jurisdiction.

3. Privacy

Our Privacy Policy describes how we collect, use, and share information, including your rights under GDPR, UK GDPR, and CCPA/CPRA where applicable. By using the Services, you acknowledge that policy.

4. Submitting Reference Images and Training AI Models

By training a character model on ClipMode, you confirm that:

• You are training a model of yourself and you are 18 or older; or
• You have obtained explicit written consent from every individual whose likeness appears in your reference images, including the right to use those images for AI training and commercial generation on this platform; and
• You will not upload images of minors or of any person without the rights and permissions described above.

You bear sole responsibility for documenting and maintaining proof of consent when required. ClipMode may request evidence of consent during investigations. We may suspend or terminate accounts that cannot demonstrate adequate rights to training data.

You remain responsible for outputs you create, including compliance with likeness, publicity, trademark, and intellectual property laws.

5. Intellectual Property and Ownership of Outputs

Subject to these Terms and applicable law, you own all Assets (images, video frames, animations, and other outputs) you create with the Services through your account. ClipMode hereby assigns to you all rights, title, and interest in and to such Assets that we may otherwise hold, for your personal or commercial use as permitted by your plan and these Terms.

ClipMode retains all rights in the platform, software, models, branding, and underlying technology. Nothing in these Terms grants you rights to our trademarks or proprietary systems except the limited license below.

5.1 License to use the platform

ClipMode grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services to train models and generate Assets in accordance with these Terms.

6. Use of the Services

You may use the Services only if you agree to form a binding contract with ClipMode, LLC and are not barred from receiving services under applicable law.

7. Refund and Cancellation Policy

Due to the high cost of GPU compute, we reserve inference capacity and incur substantial costs when you train models or generate Assets. Credit packs and most usage-based purchases are non-refundable once processing has begun, except where required by law.

Premium membership subscriptions may be eligible for a refund if you contact legal@clipmode.ai within 7 days of initial purchase and have not materially consumed included benefits. We may deny refunds where we detect policy violations, abuse, or excessive usage.

8. Payment Terms and Processors

Paid features are billed according to prices shown at checkout. Payments are processed by third-party payment providers (which may change from time to time). We do not store full payment card numbers. If a payment processor discontinues service to us or to you, we may suspend billing features, require an alternate payment method, or modify available plans with reasonable notice where practicable.

9. Restrictions on Content and Moderation

We manually and automatically review content. We may remove or refuse to distribute any content, disable models, and suspend or terminate accounts without liability where policies are violated or risk is identified.

10. Disclaimers and Limitations of Liability

The Services are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, ClipMode disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

11. Termination

We may suspend or terminate your account or cease providing all or part of the Services at any time if you violate these Terms, create legal exposure, or if continued provision is not commercially viable.

12. General

We may revise these Terms from time to time. Changes are not retroactive unless required by law. Continued use after the effective date constitutes acceptance.

13. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Except where prohibited by law, disputes arising from or relating to these Terms or the Services shall be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

14. Data Handling Upon Account Termination

Upon termination, your account data, trained models, and associated content will be deleted from our active systems within a reasonable period, subject to backup retention limits and legal holds. You may request deletion at any time via privacy@clipmode.ai. See our Privacy Policy for details.
